1. OUR CREATIVE COVENANT AND OWNERSHIP
At Murp Studios Inc., original artistry, structural innovation, and unique visual storytelling are the core of everything we create. All content, product configurations, digital media files, three-dimensional designs, hand-sculpted models, thematic styling, custom textile arrangements, and marketing assets associated with our brand are the exclusive intellectual property of Murp Studios Inc. These original works of applied art are protected under copyright, trademark, and trade dress laws in Canada and the United States, as well as globally under the Berne Convention for the Protection of Literary and Artistic Works and the Madrid System.
Our flagship product lines feature a distinctive visual composition and specialized engineering—specifically our unique integration of high-fashion, theatrical, or historical human, animal, and figurative forms as functional, structurally mounted holiday tree toppers. These configurations serve as proprietary commercial identifiers unique to the Murp Studios brand ecosystem. This protection extends across all of our evolving design capsules, editions, character dolls, seasonal figures, and curated novelty ornaments, including:
- "Cool Santa" and "Cool Ms. Claus" series
- "The Red Queen" collection
- "Cirque De Noel" line, including the Ringmaster series
- "Candyland Couture" and "Candyland" series
- "Wonderland" series
- "Family Magic / Nostalgic Movies" editions
2. TRADEMARKS AND BRAND IDENTIFIERS
Murp Studios Inc. and House 359 own and control all associated trademarks, trade names, service marks, logotypes, character designs, and brand identifiers. Our signature brand properties—including the distinct personas, illustrated layouts, and physical sculptural forms of "Cool Santa" and "Cool Ms. Claus"—are protected brand assets.
These protections encompass all commercial and multimedia applications, including our digital lookbooks, advertising campaigns, website imagery, temporary showrooms, and physical retail activations. This includes the distinct use of our numerical mark “359” and its direct variants (“The 359,” “359 Collection”) when utilized in relation to holiday merchandise, artisanal crafts, apparel, or curated design series.
3. PARTNERSHIP AND USE GUIDELINES
Welcomed and Permitted Uses:
We highly value our community of interior designers, retail stockists, and commercial partners. We welcome you to showcase, present, and market genuine Murp Studios products within your spaces, showrooms, and digital marketing materials in a manner that honors and accurately represents the original design and brand identity. The resale of unmodified products purchased directly from Murp Studios or our authorized distributors is fully permitted and celebrated.
Restricted Uses:
To protect the exclusivity and market value of our collections for all authorized partners, the purchase of our products does not grant a license to replicate, reverse-engineer, or commercially exploit our designs. We kindly ask our community to note that the following actions are strictly prohibited without our prior written consent:
- The reproduction, adaptation, or commercial creation of substantially similar products, layout concepts, or competing display systems.
- Utilizing Murp Studios public product listings, specifications, or imagery to assist third-party manufacturers or suppliers in developing look-alike product lines.
- The unauthorized use of our specific brand vocabulary, collection names, character names, signage, or storefront concepts that may cause marketplace confusion, misrepresentation of origin, or brand dilution.
4. BRAND INTEGRITY
We invest immense creative energy and development into the design, engineering, and experiential presentation of each seasonal collection. We are deeply committed to protecting the integrity of this work to ensure that our authorized partners hold a truly unique offering in the marketplace. Any presentation or marketing of our elements that implies an unauthorized corporate association, partnership, or endorsement is not permitted.
5. A COLLABORATIVE APPROACH TO ENFORCEMENT
Our strong preference is always to build professional, collaborative, and mutually beneficial relationships. We take our creative work seriously and prefer to resolve any brand preservation or copycat concerns transparently and amicably through direct professional dialogue. However, Murp Studios Inc. reserves the right to defend its trade dress and intellectual property assets through formal legal channels where necessary to protect our brand community.

6. GOVERNING LAW
To ensure consistency across our global operations, this Policy and any commercial clarity or disputes regarding Murp Studios Inc. intellectual property shall be governed by the laws of the Province of British Columbia and the federal laws of Canada. Any formal legal proceedings arising out of this policy shall be addressed exclusively in the courts located in Vancouver, British Columbia, Canada.
